Councillors are hereby summoned, and members of the public are invited, to attend a
Parish Council Meeting on Monday 3rd July 2017 at 7.30pm,
in the Silverdale Institute, Spring Bank, Silverdale,
for the purposes detailed in the following Agenda:

1. To receive apologies for absence.

2. To receive declarations of Members’ interests relating to any items appearing on the agenda.

3. To approve the Minutes of an Ordinary Meeting held on 5th June 2017.

4. To receive information about matters arising from the Minutes of previous meetings, not covered by the Agenda.

5. To hear matters raised by Members of the Public for future consideration. Note: Members of the Council are not permitted to respond, except to ask questions for the purposes of clarification only.

6 To welcome Labour Cabinet Member Councillor Margaret Pattison responsible for Markets, Voluntary Sector, Older People and Rural Affairs who will give an explanation of her role and receive questions.

11622 Minutes of the Previous Meeting
The minutes of the Ordinary Meeting held on Monday, 5th June were approved then signed by the Chairman.
11623 Receipt of Information about Matters Arising from the Minutes of Previous Meetings, not Covered by the Agenda
11462 – It was noted that the proposals for the National Grid’s North West Coast Connections project have been put on hold until the future of the Moorside nuclear plant has been decided and that correspondence has been received on this (11638 (l) below).

11517 – Regarding the siting of a British Telecom (BT) cabinet at the access to Pointer Wood (by The Chase) – Councillor Bennett advised that there is a notice on the site giving 28 days for any objections to locating the cabinet there (the owner of the land is unknown).
11603 (2) – Councillor Bond reported that he is still awaiting for a firm proposal for dealing with the damage and replacing the felled trees on parish land at Woodwell from the person responsible; RESOLVED that this be followed up next month if necessary.
11603 (3) – It was noted that South Lakeland District Council would notify the parish council automatically if an appeal is lodged in connection with the planning application for developing the former Leeds Children’s Holiday Home site.
11603 (4) – Councillor Bennett advised that he has looked through the planning application and associated documents for the houses on Keepers Green, next to Silverdale Golf Club, and, although, the Parish Council would not have supported the planning application for 2 new semi-detached dwellings had it been known that the dwellings would be holiday homes, there is no legal recourse for objecting to their use as holiday homes. RESOLVED that the Clerk still write to Silverdale Golf Club, Lancaster City Council (Lancaster CC) planning department and the developers expressing this Council’s disapproval of the dwellings being used as holiday homes.
11608 – Councillor Bennett reported that he has written an article for the parish magazine about the bus service.
11613 – Councillor Bond advised that there is no news regarding the electricity supply for the Community Public Access Defibrillator at the Bowling Club; RESOLVED that this matter be followed up next month if necessary.
11624 Matters Raised by Members of the Public for Future Consideration
Councillor Bennett anticipated that several members of the public would wish to raise the matter of the Arnside and Silverdale AONB Development Plan Document (DPD) and the additional site proposal S50 (off St John’s Avenue) and had handed out copies of a draft of Silverdale Parish Council’s proposed response to the all those present before the meeting began. Councillor Bennett asked if the public wished to raise any points in addition to those in the draft response and the following points were raised:
1. concerns about flooding in and around the vicinity of the cemetery where flooding is already a problem – it was felt that this might be exacerbated if the site off St. John’s Avenue was developed in view of the additional hard surfacing. It was noted that a planning application for an extension to the cemetery has been refused in the past and it was reported that the refusal was because of the increased risk of water-logging;
2. concerns about proposed developments on unsuitable greenfield sites generally;
3. the need for more housing in Silverdale was questioned given the number of properties for sale at a range of prices;
4. the site is used as a feeding ground by a wide variety of birds/ loss of the site as an amenity;
5. waste water treatment plants are thought to be noisy;
6. concerns about traffic – there are already parking issues on St. John’s Avenue and at the junction with Emesgate Lane; it was felt that additional traffic and parking could impede access for emergency service vehicles.
Members urged the public to make their own personal objections to Lancaster CC with reference to their local knowledge of the site and surrounding area.
One resident also raised the matter of Japanese Knotweed – he asked what steps the Council has taken to deal with it and advised that a specialist contractor will look at the Masonic Hall’s grounds.
11625 City Councillor Margaret Pattison
Lancaster City Councillor, Margaret Pattison, thanked Members for inviting her to speak at their meeting. Councillor Pattison explained that she is the Cabinet Member with responsibility for Markets, Voluntary Sector, Older People and Rural Affairs, she is also a Morecambe Town Councillor and a Lancashire County Councillor where she is a member of the Health Scrutiny Committee. Councillor Pattison gave an account of her work and spoke about her cabinet portfolios – she explained that, whilst she is not on Lancaster CC’s Planning Committee, she is involved in planning matters through her role as Cabinet Member with responsibility for Rural Affairs.
Councillor Houghton advised Councillor Pattison about the problem with ‘not spots’ in the village (areas where there is no mobile phone reception) and asked if she could campaign for a phone mast in Silverdale. Councillor Bond added that there is a mast at Silverdale Scout camp which could be used and that there were plans to install a mast at St. John’s Church, but this did not go ahead.
11626 County Councillor Philippa Williamson
Councillor Williamson reported that: (1) she is the Lead Member for Young People and under the new regime (since May) the Cabinet and Lead Members meet weekly; (2) a revised budget has been proposed and will be discussed by Cabinet this month – revisions include extra funding for buses, roads and libraries; (3) she is working on various issues raised by the Parish Council at the meeting she had with Councillors Bennett and Houghton in May: the road junction of the A6/ Nineteen Acre Lane; delivery time waiting restrictions outside the Co-operative store; the Co-Responders scheme; highways/ gulley clearing/ verge maintenance and the bus service.
Councillor Ribbons commented on the number of temporary yellow road signs in the county (e.g. diversion signs) which are positioned inappropriately, or are out of date/ no longer needed, and asked if these could be dealt with.
Councillor Bennett asked Councillor Williamson if she would keep Members updated on the above issues by email.
11627 Report from City Councillor Nigel Goodrich
Councillor Goodrich reported that: (1) he has written to the planning department to ask if restrictions can be introduced to prevent situations where planning consent has been granted for a dwelling to be used as a permanent residence being used as a holiday home (reference Keeper’s Green) and vice versa; he has been advised that restrictions are being considered; (2) he will write to Highways to seek clarification on the information given about gully clearance and will copy his email to Councillor Williamson.
Councillor Bennett requested clear details of Lancs. CC’s and Lancaster CC’s responsibilities for highways/ gulley clearing/ verge maintenance and would like a meeting with the Cabinet Member for Highways; RESOLVED that the Clerk invite the Cabinet Member to the Parish Council’s September meeting and that the Parish Council compile a list of the areas where overgrowth is causing the most problems for Councillor Goodrich to give to Highways now.
Councillor Goodrich reminded members of the public of the importance of submitting their own objections to the possible additional site proposal S50 – off St John’s Avenue and asked if this Council’s list of issues with the proposal would be published so that residents could refer to it.
11628 Reports on any Meetings Attended by Members or the Clerk

11629 Planning
(1) It was noted that no planning applications have been dealt with under the provisions of Standing Order 25a.
(2) The following planning applications were considered and comments made as indicated:

Councillor Bennett summarised the points made in 11624 above; Councillor Houghton added that, as well as the cemetery, the houses on Townsfield (which are at a lower level and are already susceptible to flooding during periods of heavy rainfall) would be at greater risk of flooding if the site was developed due to the hard surfacing. It was noted that the draft of the Parish Council’s proposed response includes detailed reasons for their concerns regarding waste water disposal arrangements for the proposed site. RESOLVED that Councillor Bennett revise the draft document to incorporate the points made at the meeting and circulate it to Members for comment.
11629 Urgent Action Taken under the Provisions of Standing Order 25 (other than Planning)
25(a) Parish Council Property and Functions

25b) Non-Parish Council Property and Functions
It was noted that there have been sightings of stands of Japanese Knotweed and Himalayan Balsam and the Clerk has alerted the land owners of the affected areas to encourage removal. Councillor Bennett advised that he has noticed more stands in the village – on the verge near the cemetery on Bottoms Lane and on the verge on Lindeth Road; RESOLVED that the Clerk notify Highways.
11630 External Services Report
RESOLVED that Councillor Bennett update the external services report prior to sending it to Councillor Williamson for information. Councillor Houghton reported that the problem with sewage discharging onto the shore has still not been dealt with, despite Highways promising to act on this in April.
11631 Toilet Door
It was noted that the Clerk has received a second quotation (from Walker Joinery and Building Services) for a new toilet door (in oak), RESOLVED that the Clerk asked for a revised quotation based on a different wood for the door as it is not necessary for it to be made of oak.
11632 Benches
RESOLVED to: 1. re-work the 9 benches which Councillor Bennett has identified as needing attention; 2. obtain prices for the materials – recycled plastic slats where practical (in the case of the benches with concrete ends) or wood if this is a more suitable material for a particular bench; 3. obtain quotations for the labour involved.
The Clerk advised that the cost of re-working the benches (estimated at £760) would need to be funded from the Council’s reserves as the amount set aside for repairs to benches from this year’s budget has already been spent.
It was noted that a resident of Yealand Redmayne has asked if it would be possible to site a second bench (in memory of his wife), close to the existing bench just past the cattle grid at Jenny Brown’s Point. It was noted that the existing bench is made of plastic. RESOLVED to contact the resident and advise him of this Council’s preference for a plastic bench so as to match the existing bench and to better withstand weathering than a wooden one (given its location). Further RESOLVED to contact the RSPB (the landowners) for in principal permission to site a second bench at the requested location.
11633 Silverdale Community Library
Councillor Bennett reported on a meeting held with Lancashire County Councillors Peter Buckley (Cabinet Member for Community and Cultural Services) and Philippa Williamson on 19th June to discuss Silverdale Library – it was noted that the minutes of that meeting had been circulated to Members and that it has been requested that the library be re-opened on an interim basis as soon as possible. Councillor Bennett updated Members on the current position – the Library Working Group are currently considering 3 options: 1. reopening the library as it was before 30th September; 2. proceeding with an Independent Community Library under the Community and Asset Transfer policy whereby the building would be leased to the Parish Council on a peppercorn rent for 125 years; 3. a satellite library – an unstaffed library facility with a book stock and self-service technology as well as computer provision and customers able to request items in the same way that they can at other libraries. Councillor Bennett advised that the model that would be least able to withstand any future changes to Lancs. CC administration is option 1 (the cost to the local authority of running the library is estimated at around £20-£25K per annum). Options 2 and 3 would be much more sustainable.
RESOLVED to find out which option(s) Lancs. CC offer before discussing this further.
11634 Bus Service
Councillor Bennett reported that he had monitored the bus service recently for a total of 10 hours period over a period of 7 days and found that, during that period, the bus kept to the timetable quite accurately and consistently – the bus is not timetabled as a connecting service for the train and, unfortunately, because it has to keep to its schedule, it is unable to wait if the train is delayed, however, the bus operator (Kirkby Lonsdale Travel) is discussing the possibility of rescheduling the 16.21 service from the station to allow more waiting time should the 16.16 train be delayed (several young people who attend secondary school in Lancaster use this train).
Councillor Bennett advised that the usage of the bus is very low – an average of 1.7 people per trip – and the viability of the service continuing is compromised. It was noted that the service is funded until April 2018. More than ever, to help ensure continuation of the service, residents are encouraged to use it as much as possible.
The Clerk reported that a resident had contacted her to say that there is no timetable on display at the station bus stop.
11635 Household Survey
It was noted that Lancaster CC’s Regeneration and Policy Service recently commissioned a district-wide Strategic Housing Market Assessment (Part II Housing Needs). A postal survey is being sent to every household in rural parishes. The data gathered will tell Lancaster CC about current and future housing needs and will assist them in developing and planning policies for housing as part of the emerging Local Plan as well as the preparation of an up-to-date housing strategy. RESOLVED to display the posters provided by Lancaster CC encouraging residents to compete the survey.

 

11636 War Memorial Wall
It was noted that the Clerk contacted the Dry Stone Walling Association about the damaged wall and was put in touch with a local dry stone waller who arranged for a colleague, Mr Tom Ashcroft, to visit the site. RESOLVED that the Clerk press Mr Ashcroft for a response and to authorise him to carry out the work if the work is priced at less than £500.
11637 Finance
(a) Councillor Ribbons conducted the monthly check of all money received by the Council and found the records to be satisfactory. It was noted that there had been the following receipt: £322 from the WI for the refurbishment of the bench opposite The Royal.

(d) Councillor Sandiford’s paper giving an update on the Emergency Plan was tabled, it was noted that most of the equipment has now been obtained and that the budget will need to take account of ongoing costs including the maintenance of the generator and battery replacement.

11639 Broadband for the Rural North (B4RN)
Councillor Bond reported that he had attended a meeting to look at how B4RN could help with those in the community who are vulnerable and isolated, the meeting was attended by representatives from the NHS. Information was also needed for implementation of the emergency plan. It had been agreed that Councillor Bond would continue heading up this group for further work.
RESOLVED that the Clerk send a copy of the loan agreement between Silverdale Parish Council and B4RN to Members in order that the terms of the loan can be referred to with regards the possibility of free connections (to which it is believed the Council is entitled) being offered to Silverdale Institute, the Gaskell Hall/ library and Silverdale School.

1. Councillor Bennett informed that: (1) the Council’s insurers, Came and Company, would like to meet the Council in September (before the insurance is due for renewal) to discuss Health and Safety/ Risk Assessments; (2) the playground gate has been replaced, but there are problems with the post.
