17 To authorise the repairs to the playground at a cost of approximately £300 for the parts + vat and using the 2017-18, £100 worth of free repairs from City Council.

18 Parking at the Station
To consider what can be done to provide parking for cars picking up passengers from the railway station.

19 Haweswater/Gaitbarrow.
To discuss Natural England’s proposals for Gait Barrow Reserve and Haweswater.

20 Streetscape
a) To decided what action to take regarding to Damage to seats at the old bus stop on Emesgate Lane. (reported to police by Neighbourhood watch)
b) To decide whether to cancel the contract for the adopting of the telephone box.

11735 Un-confirmed Minutes of the Ordinary Meeting of the Silverdale Parish Council held in the Silverdale Institute on Monday, 6th November 2017.
11736 Present: Chairman – J. (John) Bennett, Councillors T.G. (Terry) Bond, A.J. (Tony) Houghton, S.L. (Shirley) Mason, N. (Nigel) Ribbons, D. (David) Sandiford and P.N. (Paul) Williams, the Clerk – L.D. (Denise) Challenor, the Deputy Clerk – S.D. (Sue) Hayward, City Councillor N. (Nigel) Goodrich (from 8.40pm) and 36 members of the public. 11739 Minutes of the Previous Meeting
The minutes of the Ordinary Meeting held on Monday, 2nd October were approved then signed by the Chairman.
11740 Receipt of Information about Matters Arising from the Minutes of Previous Meetings, not Covered by the Agenda
11636 – the Clerk reported that the repairs to the War Memorial wall have been checked and the invoice for the work has been paid.
11660 – the Clerk reported that she has been contacted by the resident at Woodwell, who is providing two trees to replace those felled, asking that the trees be planted soon. RESOLVED that the Clerk write to the resident to confirm that, whilst the parish council will plant the trees, the cost of the labour to do so is to be paid for by the resident himself.
11671 – the Clerk advised that there has still been no update from PC Massingham with regards taking action on the parked vehicles etc on Waterslack Road.
11711 – Councillor Bennett reported that the public meeting, which was to have been held with Lancaster City Council (Lancaster CC) and South Lakeland District Council (SLDC) last month regarding the Development Plan Document (DPD), was postponed due to bad weather; Councillor Bond advised that it will now be held on Wednesday, 8th November in the Gaskell Hall.
11715 – Councillor Bennett is waiting to hear about a date for the proposed meeting between Silverdale, Warton and Yealand Parish Councils and County Councillor Keith Iddon (Cabinet Member with responsibility for Highways) to discuss Highways issues.
11719 (a) – the Clerk asked if the Council wished to proceed with the agreement to buy the British Telecom (BT) phone box on Elmslack Lane for £1 in the light of the costs of having an electricity supply connected; RESOLVED to cancel the agreement.
11719 (c) – it was noted that Mr Hankinson has made a donation for a new bench at Jenny Brown’s Point, but will contribute a further amount towards the groundwork. The Council will provide the materials to fit the bench and suggested a contribution of £80 to cover the labour costs.
11723 – the Clerk reported that she has checked with LALC on the position with regards ring fencing funds from the First Responders’ fund. LALC have advised that a parish council cannot act unless there is a statute to allow it to do so and that there is no statute that says a parish council may maintain a defibrillator or undertake health issues so s137 would have to be used. RESOLVED to accept the donation from the First Responders and use it to purchase defibrillators.
11727 – RESOLVED to include consultation for carrying out significant road works as an agenda item when the meeting about Highways issues with Councillor Iddon takes place (see above).
11729 – it was noted that all the meeting dates for 2018 have been agreed apart from a date for the Annual Parish Meeting (Parish Assembly) which will be discussed at the December meeting.
11741 Matters Raised by Members of the Public for Future Consideration
Councillor Bennett advised that Mr Glen Swainson would be attending the meeting later and suggested that any matters pertaining to Gait Barrows be raised then (see item 11752).
The following points were raised:
1. concerns about speeding vehicles in the village and a request for the parish council to fund speed cameras;
2. a resident had compiled a written report about Hawes Water and circulated some copies to members of the public.
11742 Police Report
PC Massingham was not present at the meeting and his report was not available.

RESOLVED to defer this item – it was noted that Councillor Goodrich would be arriving late to the meeting.
11744 Report from County Councillor Philippa Williamson
Councillor Williamson was not present at the meeting and her report was not available.
11745 Reports on any Meetings Attended by Members or the Clerk
1. The Clerk advised that Councillor Palmer had attended a meeting of the AONB Executive Committee on 18th October and that the minutes of the meeting had been circulated to Members.
2. Councillor Sandiford reported on a test of community emergency plans which took place at Halton Community Centre last month. Representatives from Lancaster CC, Lancashire County Council (Lancs. CC), the police and fire services attended. Most communities are planning around flooding issues and prolonged loss of utilities and all have adopted a similar approach. Councillor Sandiford noted that he will incorporate some ideas from the session into the Emergency Plan Procedure for Silverdale.

(3) It was noted that the following decision had been advised by Lancaster CC:

(4) It was noted that an appeal has been made regarding the Former Leeds Children’s holiday camp planning application, that this Council had submitted a lengthy response when the application was made, that the application had been refused then and that, as Members have not seen the grounds of the appeal, it would not be appropriate for them to comment at this stage. RESOLVED to keep this matter as an agenda item and to monitor it.

 

11747 Urgent Action Taken under the Provisions of Standing Order 25 (other than Planning)
25(a) Parish Council Property and Functions
It was noted that two trees had fallen down at Burton Well, that Councillor Bond had dealt with one himself and that Westmorland Tree Care had been called out to deal with the other. RESOLVED that the Clerk check on the possibility of Councillor Bond, as a representative on the Woodlands Management Group, having pre-authorisation to call out tree felling services (up to a set amount) when emergency action is necessary.

11749 Emergency Plan
Councillor Sandiford reported that the installation of all the Emergency Plan electrical equipment is fully compliant and he is drafting the Emergency Plan procedure which he will circulate to Members for comment. Councillor Bond added that Ash Trees Surgery will contact everyone on their register of people in Silverdale whose circumstances may make them vulnerable and ask them if they would elect to be kept on a list to be contacted in the event of an emergency. RESOLVED that the Clerk keep the list which, it was noted, would have to comply with Data Protection legislation. Councillor Sandiford is looking at ways of publicising the Emergency Plan to residents and asking for volunteers who will be needed to carry out the roles in the Emergency Plan.
Councillor Houghton asked how long the Broadband connection would last if there is no electricity – Councillor Sandiford is considering the use of a battery or generator. It was noted that there are still funds available from the grant for this (c£1K).

11752 Gait Barrow/ Hawes Water
Mr Glen Swainson, Senior Reserve Manager for Gait Barrows, Roudsea Wood and Mosses National Nature Reserves and Ms Maggie Robinson, Team Leader for South Cumbria arrived at the meeting during the agenda item on Finance. Standing Orders were suspended for this item to allow time for a presentation on Natural England’s (NE) proposal for Hawes Water from Mr Swainson and the opportunity for members of the public and Members to raise issues and ask questions of Mr Swainson and Ms Robinson.
The following matters were raised by members of the public:
1. how preliminary TPOs affect NE’s proposals;
2. strategies for stemming the decline of the marsh fragrant orchid;
3. a multi-use track for horses;
4. pollution of the water by cattle;
5. lack of consultation and a belief that the project is possibly driven by a funding deadline when a more incremental approach might be more appropriate;
6. no sign that NE is responding to the public’s objections to NE’s proposals or their suggestions for other options to restore habitats for rare species;
7. the outcome of NE’s plans is uncertain;
8. the decision to clear fell rather than selectively fell an area of beechwood.
Members discussed this Council’s response later in the meeting (see item 11758 below)
11753 Finance (Continued from Item 11751)
(d) RESOLVED to authorise the AONB to undertake the clearing of Woodwell (on 21st November) and Bank Well (on 5th December) at a cost of £130 + VAT.
(e) It was noted that Ms Lucy Barron, AONB Manager, has supplied a list of work carried out by the AONB in Silverdale during the last 12 months. RESOLVED to donate the budgeted s137 amount of £700 to the AONB (it was noted that this payment will be authorised at the next meeting of this Council) and to remind the AONB office that the signpost at the junction of Bottoms Lane and Burton Well Lane is still incorrect.
(f) It was noted that the Annual Return and Notice of Conclusion has been received, that there are no issues arising and it is being published as instructed.
(g) RESOLVED to donate £124 (under s137) towards the cost of funding the Village Directory.
11754 Report from City Councillor Nigel Goodrich
Councillor Goodrich advised that he had attended the meeting of Yealand Redmayne Parish Council earlier where Mr Swainson had also given a presentation and answered questions from the public. Councillor Goodrich reported that the main concern seemed to be the lack of consultation by NE. Councillor Goodrich also reported on: 1. plans for redeveloping the car park areas behind Lancaster Grand and the Dukes in Lancaster city centre – one issue with the plans is the loss of car parking spaces; 2. the possibility that Lancaster and Morecambe could become one parliamentary constituency under plans from the Boundary Commission; 3. a pre-consultation planning document for a mast 12.8m high (opposite The Royal).
11755 External Works Chart
It was noted that Councillor Bennett has revised the chart and Councillor Williamson has given a copy to Lancs. CC – she has asked for an update on which jobs have been completed.
11756 Playground
RESOLVED to authorise the repairs to the playground (seat for the aerial slide and replacement cargo net on the junior multi-unit) at a cost of approximately £300 + VAT for the parts and to use Lancaster CC’s £100 worth of free repairs, from their 2017/18 budget, towards the cost. Further RESOLVED that the Clerk update Mr Tim Lambert on this.
11757 Parking at the Station
It was noted that Silverdale Golf Club has been warning motorists that their vehicles might be clamped if they are parked at the Golf Club and are not users of the Golf Club. RESOLVED to discuss this matter at the next meeting of this Council.
11758 Haweswater/Gait Barrow
It was noted that: 1. a significant issue with regards to NE’s proposals for the Gait Barrow and Hawes Water nature reserve has been the lack of effective advance information to allow the public to understand the plans and to allow comment and interaction to be made in a timely manner; 2. Members appreciate that NE are responsible for managing the site in accordance with both the site designations and the applicable legislation; 3. should the work go ahead Members appreciate NE’s commitment to minimise path closures and to try, wherever possible, to reopen paths outside working hours, or provide, where possible, alternative routes within the site; 4. Councillor Williams has been involved in the detail of this matter since the Council became aware of it.
11759 Streetscape
a) It was noted that the damage to the seats at the old bus stop on Emesgate Lane has been repaired.
b) It was noted that the agreement for adopting the BT phone box had been discussed under item 11740 above.
11760 Traffic Speeding
It was noted that a significant number of drivers are not respecting the speed limits in the village. RESOLVED: 1. to ask PC Massingham to carry out speed monitoring at peak times, such as around 8am when many drivers are leaving the village for work, and to report back when such checks have been carried out; 2. that the Clerk write to Mr Clive Grunshaw, the Police and Crime Commissioner for Lancashire, to query why Silverdale does not have a Speed Indicator Device when other villages in the immediate area (in both Cumbria and Lancashire) have them; 3. that Councillor Bond, in his capacity as School Governor, ask that Silverdale School become involved with this issue (it was noted that Road Safety Week is 20th – 26th November).
11761 Items for Information
1. Councillor Mason advised that there have been reports that a beech tree is to be taken down at the junction of Stankelt Road and Bottoms Lane. Councillor Bennett added that he has been told that the tree has bracket fungus.
