8566 Un-confirmed Minutes of an Ordinary Meeting of the Silverdale Parish Council held in the Silverdale Institute on Monday, 6th August 2007.

8567 Present: Chairman – Councillor T.G. (Terry) Bond, Councillors, E. (Eve) Holden, A.J. (Tony) Houghton, S.L. (Shirley) Mason, J. (John) Taylor (part), P.N. (Paul) Williams, the Clerk – V. (Vivienne) Shiels, the Deputy Clerk – S.D. (Sue) Hayward, County and District Councillor S.M. (Sarah) Fishwick and 5 members of the public.

8569 Receipt of Declarations of Members’ Interests Relating to any Items Appearing on the Agenda
 None.

8570 Minutes of the Previous Meeting
 The Minutes of the Ordinary Meeting held on Monday, 2nd July were approved and then signed by the Chairman.

8571 Receipt of Information about Matters Arising from the Minutes of Previous Meetings, not Covered by the Agenda
 Members referred to item 8544 in which individual Members had been minuted as raising various matters with the police, it was noted that care should be exercised when naming individual Members in the minutes. The protocol with regards speaking to the press was clarified – if a Member is contacted by a reporter they should refer the matter to the Chairman or the Clerk.

 The Clerk referred to: (1) item 8549 regarding (a) the hedge bordering the playing field and bowling green and explained that she had visited the site and found there to be areas cut out but the hedge did not appear to be breached, (b) the recent incident involving birdwatchers and confirmed that she had received a detailed reply from the RSPB to her letter, (2) item 8556 regarding the publication of the Parochial Church Council (PCC) minutes on the Parish Council web site, she had spoken to Mrs Margaret Haworth, the editor of the parish magazine, and had ascertained that the church is happy for the PCC minutes to be included or not, according to the preference of this Council. Members RESOLVED to discuss this matter further at a future meeting.
8572 Matters Raised by Members of the Public for Future Consideration
 A member of the public asked if the lack of signage for Shore Road could be looked into.

 Two members of the public expressed their concern regarding the retrospective planning application for a garage at Westfield, Gaskell Close, in that the garage appears to be significantly higher than is indicated in the plans, the building has apparently affected the light and privacy of a neighbouring house and there are queries as to the infringement of the boundary of the adjacent house, the use of the garage and the appropriateness of the scale of the garage. Photographs of the property were passed to this Council for information.

8573 Update from the Community Police Officer
 PCSO Hurtley had updated the Clerk on the incidents of reported crime during the past month: (1) a car had been broken into on Storrs Lane and a handbag stolen, (2) a tent had been damaged at Gibralter Farm, (3) there had been a number of disturbances at the Royal Hotel.

 It was noted that PC Bassinder is absent from work due to ill health and has been unable to attend meetings for some time. RESOLVED that the Clerk write to Inspector Gary Roberts to express concern as Police and Communities Together (PACT) meetings have not taken place in PC Bassinder’s absence.
8574 Report from County and District Councillor Sarah Fishwick Councillor Fishwick gave a verbal report on the following: (1) the problem of cars being parked on grass verges – Councillor Fishwick has contacted Highways regarding this, (2) blocked gullies – it was noted that there are a number of these in the village and that there is a need for a general overhaul, (3) signage – she is still in contact with Lancashire County Council (Lancs. CC) about this. It was again noted that it would be useful to invite a representative from Lancs. CC to a meeting of this Council regarding their policy on signage, (4) traffic speed – Councillor Fishwick will check that the plans for a 20mph traffic zone, from the corner of Stankelt Road and Emesgate Lane to the junction of Cove Road and Emesgate Lane (including all roads leading off Emesgate Lane), will be available for consultation before the next meeting of this Council. The proposed plans include road humps (‘cushions’ rather than full road width humps), (5) ‘Dangers in the Bay’ – a leaflet warning of the dangers is in the process of being produced, this will be distributed to all schools in the Morecambe Bay area, (6) the map on the butcher’s wall – Councillor Fishwick has received a number of comments about the map including the difficulty of reading it, incorrect representation of the salt marsh and incorrect labelling of Cove House.

8575 Reports on any Meetings Attended by Members, or the Clerk
 1.  LAPTC
 Councillor Williams had attended a meeting, there had been some discussion on the new Code of Conduct for Councillors.
 2.  AONB Executive Committee
 Councillors Taylor and Williams had attended the quarterly meeting at which the management plan and United Utilities’ plans for a new sewerage plant had been discussed.
 3.  Councillor Taylor had met with a Railway Inspector regarding the level crossing on 10th July, the report of the Inspector’s findings will be sent to this Council for information.

 13.  Rosemary Speak re. ‘bridal’ paths. RESOLVED that the Clerk reply to Ms Speak thanking her for her amusing letter and stating that the spelling mistake was corrected at the July meeting of this Council; the published minutes are unconfirmed and the version produced in the parish magazine is edited.
 14.  Action for Silverdale Trust –  July playground inspection.
 15.  The Playing Field newsletter, summer 2007.
 16.  RSPB Leighton Moss  –  reply to letter re. Birdwatchers. RESOLVED to invite Mr Robin Horner (RSPB) to a future meeting of this Council and to ask the police to comment on this Councils’s letter to the RSPB, a copy of which had been sent to them.
 17.  Lancaster CC  –  polling district, polling places, polling stations review.
 18.  Brain Scragg  –  refuse and recycle bins. RESOLVED that this matter should be an agenda item at the next meeting of this Council.

8577 Planning
 (1)  It was noted that the following planning applications were dealt with under the provisions of Standing Order 25a, and comments made as indicated:
  07/00792/FUL  –  Bracken, Woodwell Lane  –  erection of garage with shed:  NO PLANNING OBJECTIONS.
  07/00848/FUL  –  Emesgate Cottage, 12 Emesgate Lane  –  erection of single storey extension to replace existing porch and erection of conservatory:  NO PLANNING OBJECTIONS.
  07/00921/FUL  –  2 Jack Scout Cottages, Lindeth Road  – various extensions and alterations:  PLANNING OBJECTIONS  –  Members are concerned about the size of the proposed extension, the effect upon neighbours of a driveway of trees and the likelihood of the tree surviving a move.
  07/00943/FUL  –  25 Townsfield  –  various extensions and alterations:   NO PLANNING OBJECTIONS.

 (2)  The following planning applications were considered and comments made as indicated:
  07/00984/FUL  –  1 Lindeth Road  –  erection of porch to rear:  NO PLANNING OBJECTIONS.
  07/00986/FUL  –  Westfield, Gaskell Close  –  erection of conservatory and double garage:  PLANNING OBJECTIONS on the grounds that:
  1.  Members were unable to properly consider the retrospective application as the plans submitted appeared to be an inaccurate representation of what has been built e.g. with regards the position of the extension. Members were also concerned as to the use and size of the store in the application.
  2.  The size of the building is considered too large for the locality and to be unsuitable for the size of the house.

  Members wished to record their dismay that not only is this application retrospective but also, by Lancaster CC not providing sufficient regulatory oversight, the building was not constructed according to the submitted plans. 
 (3)  It was noted that the following decisions had been advised by Lancaster CC:
  07/00529/FUL  –  7A Stankelt Road  –  erection of single storey extension: GRANTED.
  07/00568/FUL  –  19 The Row  –  retrospective application for erection of patio and new access steps to front:  REFUSED.
  07/00591/FUL  –  14 Levens Way  –  retention of existing gates and erection of new boundary walls:  GRANTED.
  07/00721/FUL  –  43 Stankelt Road  –  erection of detached garage:  GRANTED.
  07/00848/FUL  –  12 Emesgate Lane  –  erection of single storey extension and erection of conservatory to front:  GRANTED.
  07/00792/FUL  –  Bracken, Woodwell Lane  –  erection of double garage with shed:  GRANTED.
  07/00514/FUL  –  Silverdale Golf Club  –  installation of water storage tanks: GRANTED.
  07/00462/FUL  –  13 Emesgate Lane  –  demolition of existing outbuilding and conservatory and erection of new conservatory:  GRANTED.

8578 Urgent Action Taken in Accordance with Standing Order 25 (other than Planning)
 25(a)  Parish Council Property and Functions
 It was noted that:
 1.  the Clerk had contacted Mr Phil Hargreaves about a fallen tree at Bankwell. RESOLVED that (a) £60 be paid for someone to help Mr Hargreaves remove the tree, (b) the Clerk draw up a list of all TPOs on Council property for future reference.
 25(b)  Non-Parish Council Property and Functions
 None.

8579 Bank Account
 RESOLVED that the Chairman and Councillors Fletcher and Mason sign the forms enabling the Council’s change of bank signatories to take place as soon as possible. It was noted that the forms are already with Members.

8580 Code of Conduct
 RESOLVED that Members adopt the Model Code of Conduct, as detailed in the Local Authorities (Model Code of Conduct) Order 2007 no. 1159, including section 12 (2), which will have effect as if it contained like provisions to Standing Order 1 (b). It was noted that Lancaster CC is offering training on the Code on 31st August at 6.00pm and 3rd September at 2.00pm at Lancaster Town Hall and that Members should notify the Clerk if they would like to attend.

8581 Past Minutes
 It was noted that the Minutes of this Council for the period January 2004 to December 2006 have been sent to the Public Records Office, Preston.

8582 Training
 It was noted that LAPTC offer training to Members and Clerks as 2 modules, module one being on roles, responsibilities and procedures and module 2 on budgets, precepts and planning. RESOLVED that the Clerk arrange for the training to take place over 2 evenings at a cost of £190 per session, the preferred days being Tuesday and Thursday (venue to be decided).

8583 Allotments
 The Clerk advised that if local people feel that there is a need for allotments, which is not being met, they can get together a group of 6, who are on the electoral roll, and put their case to the local authority (Lancaster CC). RESOLVED that Councillor Williams look into this matter further.

8584 IT Requirements
 RESOLVED to defer a review of the IT/equipment needs of the Council to the next meeting.

8585 Tide Tables
 It was noted that tide tables for Arnside are produced in the Westmorland Gazette and for Heysham in the Lancaster Guardian and that there is a copy of the tide tables for Arnside by the pier. RESOLVED that the Clerk contact the Clerk at Arnside for advice on how tide tables for Silverdale might be produced, this Council can then consider how this information might be provided in Silverdale.

8586 Finance
 (a)  It was noted that bank statements are provided quarterly by the Alliance and Leicester and that they were not available for inspection.
 (b)  RESOLVED to authorise payment for the following accounts:

8587 Amenities Under Threat
 RESOLVED to defer a discussion of inns and public houses in Silverdale to the next meeting.

8588 Items for Information
 1.  Councillor Holden advised that: (a) some areas of the path outside the Co-operative shop are in need of attention, (b) there have been complaints about litter at Woodwell.
 1.  Councillor Mason advised that: (a) the public conveniences on Bank House Lane are in poor condition, (b) older children are playing on equipment in the children’s playground designed for use by younger children and that there is no notice indicating age limits, (c) there is a need for more signage at Pool Bridge indicating that the bridge is narrow.

8589 Suggestions for Future Agenda Items
 1.  The proposed plans for a 20mph traffic zone on Emesgate Lane (Chairman).
 2.  The need for amendments to the map outside the butcher’s shop, with reference to copies of the map (All).
 3.  The need for a pedestrian facility at the station to enable safe crossing between platforms and problems with parking on the road at the station (Councillor Houghton).

8590 Date of Next Meeting
 It was noted that the date of the next meeting is Monday, 3rd September 2007. Items for the agenda and copies of reports to reach the Clerk before Friday, 24th August.
