8895 Un-confirmed Minutes of an Ordinary Meeting of the Silverdale Parish Council held in the Silverdale Institute on Monday, 6th October 2008.
8896 Present: Chairman  –  Councillor T.G. (Terry) Bond, Councillors A.W. (Arthur) Graves, E. (Eve) Holden, A.J. (Tony) Houghton, D. (Dorothy) Kitson, S.L. (Shirley) Mason, J. (John) Taylor and P.N. (Paul) Williams, the Clerk  –  L.D. (Denise) Challenor, the Deputy Clerk  –  S.D. (Sue) Hayward, PC 2866 Tony Marsh, County and District Councillor S.M. (Sarah) Fishwick and one member of the public.

8897 Apologies for Absence: none.

8898 Receipt of Declarations of Members’ Interests Relating to any Items Appearing on the Agenda
Councillor Mason expressed an interest in agenda items 15 and 19 in that she is a resident of Bank House Lane.
8899 Minutes of the Previous Meeting
The Minutes of the Ordinary Meeting held on Monday, 1st September were approved then signed by the Chairman.

8900 Receipt of Information about Matters Arising from the Minutes of Previous Meetings, not Covered by the Agenda
The Clerk referred to: (1)  item 8867, regarding the planning application for 20 Emesgate Lane, and advised that she has still not had a reply to her letter from Lancaster City Council (Lancaster CC), (2)  item 8872, regarding the Parish Council web-site, and reported that she has been in contact with the web-site provider who has advised that the reinstatement of the web-site is being treated as a priority, (3)  item 8883, regarding concessionary bus passes, and advised that her letter to Lancashire County Council (Lancs. CC) has been acknowledged.

Members referred to: (1)  item 8862, regarding the Chairman’s letter to the First Responders and RESOLVED that the Clerk write to ask for a reply, (2)  8892, regarding two walls owned by the National Trust, and noted that the wall on Stankelt Road has been repaired but that the one on The Shore is still in need of urgent attention.

Councillor Mason referred to item 8892 and advised that the area around the public toilets has been cleared up and the fence has been repaired.

8901 Matters Raised by Members of the Public for Future Consideration
A member of the public expressed his concern regarding the extension which is being built at 10 Levens Way and the apparent discrepancy between the building works and the plans submitted to Lancaster CC, for example it would appear that the extension is closer to the boundary fence than is indicated on the plans. An amended planning application has been submitted but there is concern as to the use of retrospective applications; Members were asked for their support in objecting to the plans.

8902 Update from the Community Police Officer
Members congratulated PC Marsh on his appointment as the permanent Police Constable for Silverdale.

PC Marsh gave a verbal update: (1)  3 crimes have been reported in the last month – a key had been stolen from a property in Townsfield and there had been burglaries at the restaurant and pharmacy, (2)  the speed radar gun continues to be used. Members noted that there is a problem with traffic speeding in the area of the Woodlands Hotel and Bottoms Lane.

Members asked that parking (including inconsiderate parking on Shore Road) and speeding remain as priorities for the police.
8903 Report from County and District Councillor Sarah Fishwick
Members RESOLVED to defer agenda item 7 as it was hoped that Councillor Fishwick would be able to attend the meeting later.

8904 Reports on any Meetings Attended by Members, or the Clerk
It was noted that there is to be a meeting on 10th November between the Silverdale School governors, staff and PTA to discuss the Multi Use Games Area (MUGA).

8905 Correspondence
Receipt of the following items of correspondence was noted and any action determined as indicated:
1.  RoSPA Play area safety inspection report.
2.  The National Trust gives its reasons for refusing the Parish Council’s request to use some of its land on Townsfield for allotments. Members RESOLVED to continue to look at other possible areas for allotments.
3.  FLAG Newsletter
4.  LALC Minutes of the 209th Meeting of the Lancaster Area Committee.
5.  Information about the 2008 Countryside Alliance Awards which are now open to nominations.
6.  Consultation entitled “The making and enforcement of byelaws”.
7.  Standard – Publication by the Standards Board, Sept.08
8.  Clerk and Councils Direct.
9.  Notice of an annual meeting (of bikers) at Gibraltar Farm. Live music, 3 day event. 10th-12th October.

8906 Planning
(1)  It was noted that no planning applications were dealt with under the provisions of Standing Order 25a.
(2)  The following planning applications were considered and comments made as indicated:
• SL/08/01122/FUL  10 Levens Way  –  amendment to roof on application 07/1303/FUL for the erection of a single storey extension  –  PLANNING OBJECTIONS as follows:
1.  Given the comments of a neighbour it would seem that there is a significant difference between the plans which have been sent to this Council and the building itself. RESOLVED that the Clerk request up-to-date plans.
• 08/00978/FUL Waterslack Garden Centre  –  amendment to application of erection of 14 holiday lodges and change of use of existing flat and farm shop premises to form a single dwelling  –  PLANNING OBJECTIONS as follows:
1.  The objections made previously by this Council still stand.
2.  This Council is concerned that if the road is left in place this will allow the possibility of future developments.
3.  This Council is concerned about the proposed lack of site management.
4.  If the farmhouse is returned to residential use some delineation of the parking area is requested.
• 08/01102/FUL 20 Emesgate Lane  –  various alterations plus erection of first floor rear extension and alterations including erection of first floor balcony  –  NO PLANNING OBJECTIONS.
• 08/01053/OUT 22 Emesgate Lane  –  outline application for the erection of a 2 storey dwelling with garage  –  PLANNING OBJECTIONS as follows:
1.  This Council is concerned about highway access.
2.  The land rises which means that the development will overlook other properties in the area including 23 Spring Bank and 24 Emesgate Lane.
3.  Backland development is against Lancaster CC policy.
(3) It was noted that the following decisions had been advised by Lancaster CC:
• TPO no. 443 (2008) at Abbeyfield, Cove Road. Grid reference 345697 – 475608.
• Notice of intention to carry out works to trees  –  08/0080/TPO143, Copper Beech at Barns Side, 3A The Green and 08/0075/TPO Ash trees at 39 Lindeth Road.

8907 Report from County and District Councillor Sarah Fishwick
Councillor Fishwick reported that: (1)  she had attended a planning meeting at Lancaster CC at which an application from Waterslack Garden Centre had been deferred and an application regarding Letter Box Field, Ford Lane had been granted, (2) every parish council in the Lancaster CC area is to be consulted on the future of special expenses relating to Council Tax.

Members asked Councillor Fishwick if she would contact Highways regarding the overhanging trees which are still in need of attention at Slackwood Lane.

8908 Urgent Action Taken in Accordance with Standing Order 25 (other than Planning)

8909 Draft Budget
RESOLVED to agree the draft Parish Council budget for 2009/ 10. It was felt that the availability of Section 137 monies should be made more widely known.

8910 2007/ 08 Audit Return
RESOLVED to approve the amendment to line 11 of Section 1 on the audit return (regarding Trust funds disclosure) to read ‘no’. It was noted that the Statement of Significant Variations now includes information regarding the figures on line 4 of Section 1 (regarding staff costs) and that additional information had been requested with regard to Mr Peter Challenor’s gratuity payment.

8911 Roadside Railings
Members noted that the gate on Slackwood Lane, and all the roadside railings in Silverdale owned by Lancs. CC (533 yards in total), are in need of repainting. RESOLVED that the Clerk write to the AONB asking if they would quote for the labour costs to prepare the railings for repainting and repaint, and to indicate a timescale for the work to be carried out. It was noted that the paint will be provided by Lancs. CC.

8912 Car Parking at Bank House Lane
RESOLVED to ask Lancs. CC if an ‘H’ bar can be marked on the road to cover the entrance to Bank House Lane (approximately 8 metres long); it is hoped that this will help to improve the problems with parking at, and access to, Bank House Lane.

8913 Bankwell
RESOLVED to ask the AONB if Bankwell can be cleared of choking vegetation in November at a cost of £100 +VAT.

8914 Charity Status
RESOLVED that the Clerk contact the Charity Commissioners regarding the possibility of extending the charitable status of the playing field to cover the proposed site of the MUGA.

8915 Finance
(a)  It was noted that no money had been received by the Council since the last meeting.
(b)  RESOLVED to authorise payment and sign cheques for the following accounts:
Mr Phil Hargreaves (Materials for clock and seats)  £400.00 (317)
Playsafety Ltd (Playground – RoSPA inspection)    £91.65 (318)

8916 Public Toilets
RESOLVED that the Clerk write to Lancaster CC and ask that the condition of the toilets be monitored daily (when the toilets are cleaned); RESOLVED to discuss the possibility of a Service Level Agreement with Lancaster CC if the condition of the toilets does not improve.

8917 Items for Information
1.  Councillor Holden reported a blocked gully outside 19 Hazelwood.
2.  Councillor Mason reported that: (a)  the footpath that leads from Lindeth Close to Lindeth Road is covered in moss and is dangerously slippy, (b)  there is no information available on the Silverdale Shuttle bus service at the Rural Intelligent Bus Stops.
3.  Councillor Taylor advised that he has been in contact with Kirkby Lonsdale Coaches and had been informed that the suspension on the buses is checked every 6 weeks but that drivers will be asked to drive more slowly along country lanes, (b)  from 3rd November there will be a Silverdale – Lancaster bus service operating on Mondays, Wednesdays and Fridays.

It was noted that the date of the next meeting is Monday, 3rd November 2008. Items for the agenda to reach the Clerk before Friday, 24th October, and copies of reports to reach the Clerk before Monday, 27th October.
