9512 Un-confirmed Minutes of an Ordinary Meeting of the Silverdale Parish Council held in the Silverdale Institute on Monday, 6th December 2010.

9513 Present:  Chairman  –  Councillor T.G. (Terry) Bond, Councillors A.J. (Tony) Houghton, S.L. (Shirley) Mason, J.S. (John) Taylor and P.N. (Paul) Williams, the Clerk  –  L.D. (Denise) Challenor, the Deputy Clerk  –  S.D. (Sue) Hayward and County and District Councillor S.M. (Sarah) Fishwick, Mr Brian Jones, Executive Committee Member of the Campaign to Protect Rural England (CPRE) Lancashire and of the Friends of the Lake District (FLD) and 3 members of the public.

9513 Apologies for Absence:  Councillors A.W. (Arthur) Graves, (Eve) Holden and A. (Anne) McNaughton and PC 2866 Tony Marsh.

9514 Receipt of Declarations of Members’ Interests Relating to any Items Appearing on the Agenda
 Councillor Williams expressed an interest in agenda item 10 in that he is employed (as a member of the public) to clean the toilets.

9515 Minutes of the Previous Meetings
 The Minutes of the Ordinary Meeting held on Monday, 1st November were approved then signed by the Chairman.

9516 Receipt of Information about Matters Arising from the Minutes of Previous Meetings, not Covered by the Agenda
 The Chairman referred to: (1) item 9501, regarding Lancaster planning and housing rural consultation, and advised that he had not met with Mr David Hayward to discuss these matters as yet, (2)  item 9502, regarding the War Memorial Gardens, and reported that the dead trees were replaced before Remembrance Sunday, (3)  item 9506, regarding Bank Well, and informed that the AONB had been unable to carry out the planned works as the pond was frozen but that the area around the pond would, at least, be cleared and mown after the snow and ice has melted.

9517 Matters Raised by Members of the Public for Future Consideration
 None.

9518 Update from the Community Police Officer
 A written report from PC Marsh was read by the Chairman: (1)  in the last month one crime has been reported – the theft of signs from The Shore car park, (2)  there have been no other incidents of note, (3)  in relation to the PACT priorities the village has been patrolled regularly to deter anti-social behaviour and inconsiderate parking, (4)  it is not going to be possible to conduct speed enforcement in the village due to the lack of a suitable, safe site, (5)  at the beginning of November the police conducted Operation Brittle, this was an overnight operation with assistance from the Lancaster Rural Police Team, Cumbria Constabulary and North Yorkshire Police aimed at rural crime and travelling criminals. The operation was a success with four arrests, six people/vehicles searched and over thirty other vehicles/people stopped and spoken to. It is hoped to repeat the operation again in the New Year.

 RESOLVED that the police continue with the same PACT priorities.

9519 Report from County and District Councillor Sarah Fishwick
 Councillor Fishwick reported that: (1)  road gritting in the village has gone well, (2)  she is now a member of the United Hospitals Trust, (3)  the private road that leads from Stankelt Road (at the back of West Lindeth) has been tarmacked.

9520 Reports on any Meetings Attended by Members, or the Clerk
 1.  Lancashire Association of Local Clerks
 The Clerk reported that she had attended a finance workshop which had proved very informative.

 2.  Silverdale United Charities
 Councillor Mason advised that she had attended a meeting at which an application for grant aid had been approved.

9521 Address from, and Discussion with, Mr Brian Jones, Executive Committee Member of the Campaign to Protect Rural England (CPRE) Lancashire and of the Friends of the Lake District (FLD) regarding the Ownership of Bank Well
 Mr Jones explained that Mr T.S.H. (Sid) Wordsworth, who died in 1989, had bequeathed the land at Bank Well to CPRE Lancashire but that they were not able to hold land and so FLD took it over. It had been agreed by all parties that Silverdale Parish Council was a suitable final owner and protector and that the land should be kept for amenity purposes, however, the land transfer does not seem to have taken place.  RESOLVED that: 1.  the Clerk contact the Land Registry to enquire as to the ownership of the land, 2.  if it is confirmed that the land is not in this Council’s ownership the Clerk contact the Executor (a solicitor from a Blackpool firm). The Council asked Councillor Fishwick if she would make enquiries as to whether or not the legal department of either Lancaster City Council (Lancaster CC) or Lancashire County Council (Lancs. CC) can help.

9522 Urgent Action Taken in Accordance with Standing Order 25 (other than Planning)
 25(a)  Parish Council Property and Functions
 The Clerk had taken action regarding the electricity supply to the public toilets – a local electrician, Mr Keith Higginson, had inspected the electrics and had found that they were inadequately earthed, his report highlighted what needs to be attended to for safety reasons and he had made the lighting system safe in order that the toilets could remain open. No charge had been made for this work.  RESOLVED that the Clerk write on behalf of this Council to thank Mr Higginson.

 It was noted that the Clerk has received a quote (from another electrician) for £956.60 for carrying out the works necessary for the electrics to comply with current regulations. The Clerk has contacted Lancaster CC who have agreed to pay for the repairs as the electrics had not been inspected prior to the management being taken over by this Council.
 25(b)  Non-Parish Council Property and Functions
 None.

9523 Correspondence
 Receipt of the following items of correspondence was noted and any action determined as indicated:
 a)  A resident supplies a copy of his correspondence to the Camping and Caravanning Club, with regard to Woodlands (copy supplied).
 b)  The Camping and Caravanning Club inform that they will not proceed with the application to put a site at “The Woodlands”.
 c)  Mr David Morris MP replies to this Council’s letter about rail and bus issues in Silverdale. (Copies supplied.) It was noted that not all the points raised in the letter had been addressed.  RESOLVED to supply Councillor Fishwick with a copy of the letter for information and to display the letter on this Council’s notice board (when space allows).
 d)  Lancaster CC write to offer 4 playground inspections a year free of charge (commencing 1/4/11). £100 worth of repairs may also be carried out per year at no charge.  RESOLVED to accept the offer.
 e)  Ms Lucy Barron informs that Mr Colin Peacock has stood down as Chair of the AONB, Parish Councillors are encouraged to consider the role, initially for one year. Expenses will be paid. Further information is available.
 f)  A copy is supplied of a resident’s letter with comments and objections to planning application 10/01020/FUL – 3 St Johns Avenue.
 g)  Lune Valley Rural Housing Association write to inform that they propose to use “To Let” boards when one of their houses becomes empty in the future.
 h)  LALC provide minutes of their 222nd meeting on 27/9/10; Annual report 2009/10; Government advice regarding snow and ice; NALC employment briefing; Job vacancy at Wittingham.
 i)  Joint Committee for Strategic Planning give a Minerals and Waste Development Framework update.
 j)  War Memorials Trust Bulletin.
 k)  Keer to Kent publication.
 l)  Clerk and Councils Direct.
 m)  AONB annual report with a request for a donation.

9524 Planning
 (1)  It was noted that the following planning applications were dealt with under the provisions of Standing Order 25a and comments made as indicated:
 10/01075/OUT  Old Waterslack Farmhouse, Waterslack Road.  Erection of log cabin for live/work unit. It was noted that this Council felt it had insufficient information to make a decision, e.g. it is not clear what would happen to foul sewerage, the elevation details seemed incomplete and it is not clear how the site is to be accessed.
 10/01020/FUL  3 St Johns Avenue.  Demolition of existing dwelling and erection of 2no. 4 bed dwellings with associated on site parking.  PLANNING OBJECTIONS as it is felt that the size of the proposed housing is inappropriate given the surrounding buildings are primarily bungalows – the proposal is for large two storey houses with large roof space and will dominate; it is also not clear where the sewerage would go and how the development would be accessed.
 10/01126/FUL  Brentin Cottage, Shore Road.  Erection of an Extension.  NO PLANNING OBJECTIONS.
 10/01138/FUL  5 Maryland Close.  Erection of a porch.  NO PLANNING OBJECTIONS.
 (2) The following planning applications were considered and comments made as indicated:
? 10/0116/FUL  2 Castle Bank.  Erection of a replacement garage to side.  NO PLANNING OBJECTIONS.
 10/001151/FUL  Land at Claughton Quarry, Claughton Moor.  Erection of 13 wind turbines with associated buildings and access. (CD available from the Clerk.)  NO PLANNING OBJECTIONS.

9525 Finance
 (a)  It was noted that no money had been received by the Council since the last meeting.
 (b)  RESOLVED to authorise payments and sign cheques for the following accounts:
 United Utilities Water Plc (toilets)     £161.60  (600349)
 Lancaster CC (AONB donation)     £700.00  (600353)
 Mr Paul Williams (toilet cleaning)     £185.32  (600354)
 (c)  RESOLVED to check the meter reading to the public toilets (taken at the time that this Council took over the management from Lancaster CC) following the receipt of the electric bills sent by Npower (£67.72, £33.24 and £192.49); it was noted that the reading is displayed in the toilets and that Councillor Williams would advise the Clerk of the reading.

9526 Website
 RESOLVED to add this Council’s Standing Orders and Financial Regulations to the Parish Council’s website.

9527 Items for Information
 1.  The Chairman advised of ‘Silverdale Events Update’ – a newsletter produced by one of the villagers giving listings by e mail (residents can sign up for the newsletter by sending their name and email address to newsletter@silverdale.eu; future events to be included can be notified via events@silverdale.eu; website address: www.silverdale.eu). The newsletter also has links to various organisations including Silverdale Parish Council and the Silverdale Events Update Forum.
 2.  Councillor Mason reported that a resident had noted that, apparently, individuals have been using grit from the grit bins on their own property.

9529 Date of the Next Meeting
 It was noted that the date of the next meeting is Thursday, 6th January 2011. Items for the agenda to reach the Clerk before Friday, 31st December and copies of reports to reach the Clerk before Monday, 3rd January.
